If a person buys a land in return agrees to construct a house for the owner and for himself, some of the expenses like additional TDR etc have been purchased in the name of owner himself, then will the GST be applicable on such flats given, if yes, then will it be at 5% of Market value or this will be considered as construction service and will be charged at 18%? The person who bought the land has no intention to sell the flats and he has constructed it for his own residence.
