The rate of tax cannot be subjected to any conditions. This is changeable. However, in rate notification 11/2017 option is not given to charge 5% without ITC or 18% with ITC. As per CC.B.I. & C. Circular No. 85/04/2019-GST, dated 1-1-2019 rate for canteen service is 5%.
