This is a tender condition and not a requirement flowing from GST law. You may challenge this condition as being unlawful but may be defended as a requirement of the concerned department given the nature of work involved. Generally, requirement of HO in State is more onerous than a requirement to have a ICAI-recognized branch in the State. Please ask for this relaxation and if it is denied, then you may have a case to challenge the condition as being unlawfully. Please seek legal help on this matter but note that this is not a condition flowing from GST law.
